DENVER, CO. – April 25, 2019 – The law firm of Chipman Glasser, LLC obtains Victory in Colorado Court of Appeals
In a published decision Thursday, the Colorado Court of Appeals reversed a summary judgment that had been entered against a Chipman Glasser client totaling more than $2.5 million. The case will be remanded to the trial court for further proceedings. The case concerned opposing claims for breach of two contracts, and the appellate court found that the trial court improperly entered summary judgment by departing from a prior order deciding that a trial must occur to determine which party breached the contracts first.
“We are very pleased that the court of appeals reached the correct result in this case,” said John Bowlin, one of the attorneys who brought the appeal. “The trial court’s summary judgment was improperly entered and now our client will get to have its day in court, as Colorado law requires.”
